Michael Lowe
My practice is focused in the areas of commercial litigation, real estate, business transactions as well as business consulting. For over 30 years I have litigated matters involving contract disputes, construction claims, mechanic’s liens, trade secrets, restrictive covenants and conflicts between shareholders, members, partners, and directors in a wide array of matters.
I also represent buyers and sellers of residential and commercial real estate, as well as landlords in eviction proceedings.
In addition, I counsel individuals or groups in existing companies and those who are forming new business ventures who are in need of shareholder agreements and operating agreements.
I have handled over 20 appeals in the Appellate Division and the Court of Appeals.
Representative Clients
For the past 15 years I have been outside counsel to The Moinian Group, one of the largest privately owned real estate developers in the country, with over 20 million square feet of space under their ownership, management or development.
I also represent Materials Testing Lab, Inc. and American Aerospace Controls, Inc., two of Long Island’s leading testing and manufacturing companies.
In addition, I am counsel to the owners and developers of The Space at Westbury, the premier music and entertainment venue in Nassau County.
I have also represented Millennium Films, one of the longest-running independent film companies in Hollywood.
Leading Court Decisions
Lombardi v. Stout, 80 N.Y. 290 (1992) (Court of Appeals)
Expanded strict liability against property owners for injuries sustained by falling worker. This decision has been cited in over 450 published cases.
Blue Angel Films Ltd. v First Look Studios, Inc., 2011 WL 830624 (2011)
Holding that a party had standing to quash a subpoena served on a non-party, Millennium Entertainment, LLC.
